RTH Offset not being honoured

Settings > Flight Control > RTH Offset
My RTH Offset is set to 0m, my mission is at 90m yet the drone ascends to 140m to RTH when the battery is spent. Not only is this a waste of time and battery but also Illegal for me to do so.

Please post a link to the flight in our system that does this. 

If you are operating using Terrain Aware it will set the RTH height value according to the highest encountered terrain on the flight path.
