You know that but the aircraft has no way of knowing that. The aircraft has no knowledge of the underlying terrain so we set it to what has been determined to be a safe margin through years of trial and error (heavy on the error). The worst email we get is the one that says someones aircraft was intentionally flown into something.
We jump through hoops to keep people from crashing into mountains, trees, cliffs, power lines, towers, buildings, etc. We have seen it all at this point. If you don't like how it is coming home you are free to interrupt the return pilot it in yourself.
